1. Acceptance of terms

By creating an account, recharging your wallet, or using any part of the SendRCSMessages platform ("Service"), you ("Client," "you," "your") agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. These terms apply to direct clients as well as resellers and white-label partners operating under their own sub-accounts.

The Service is operated by INTELARIS STRATEGIES PRIVATE LIMITED ("SendRCSMessages," "we," "us," "our"), with its registered office at 100-3A, First Floor, Raghuleela CHS LTD, 150 Feet Road, Bhayandar (West), Thane – 401101, Maharashtra, India.

2. Description of service

SendRCSMessages provides a managed RCS (Rich Communication Services) Business Messaging platform that enables verified senders to deliver branded, interactive messages — including rich cards, carousels, and standard RCS messages — to RCS-enabled devices in India. Messaging is delivered through Google's RCS infrastructure in combination with carrier connectivity (including Jio) and CPaaS/aggregator infrastructure.

RCS delivery depends on the recipient's device, operating system, carrier, and the Google Messages app being active and RCS-enabled on their handset. We do not guarantee delivery to every device, carrier, or region in India. Where a recipient is not reachable on RCS, message delivery may fall back to SMS only where such fallback has been explicitly configured for your account.

SendRCSMessages is an RCS messaging solution provider, connected via approved RCS infrastructure. We are not Google, GSMA, or any telecom operator, and nothing in these terms should be read as implying a direct partnership, agency, or joint venture with any such entity.

3. Eligibility & account

You must be a registered business or authorized representative of one to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account, including sub-accounts created by you as a reseller.

You agree to provide accurate business information during onboarding, including any information required for sender verification with Google RBM and/or carrier approval. Delays or rejections in verification caused by inaccurate or incomplete information are not the responsibility of SendRCSMessages.

4. Billing & prepaid wallet

The Service operates on a prepaid wallet basis. You must maintain a sufficient wallet balance to send messages; messages will not be sent if your balance is insufficient.

• Wallet recharges are processed at the per-message rates applicable to your account at the time of recharge, plus applicable GST.
• Per-message rates may vary based on message type (Basic RCS, Rich Card, Carousel), volume commitments, and any commercial terms separately agreed with you. Published rates on our Pricing page are indicative and subject to change with notice.
• Wallet balance is deducted per successfully attempted message send, in accordance with our billing logic disclosed to you at onboarding.
• Unused wallet balance does not expire unless otherwise stated in your specific commercial agreement, but is non-transferable to another account without our written consent.
• Refunds of wallet balance are handled under our separate Refund Policy, which forms part of these terms.

5. Acceptable use

You agree not to use the Service to send messages that:

• Are sent without the recipient's consent, or to numbers acquired through purchased/scraped lists without a lawful basis to contact them;
• Violate India's Telecom Commercial Communications Customer Preference Regulations (TCCCPR), the IT Act 2000, the Digital Personal Data Protection Act 2023, or any other applicable law;
• Contain fraudulent, deceptive, defamatory, obscene, or unlawful content, including phishing attempts or requests for sensitive credentials (passwords, OTPs, card details) framed as a reply to the message;
• Infringe any third party's intellectual property or privacy rights;
• Are likely to be flagged as spam by Google RBM, carriers, or recipients at a rate that risks your sender verification or our carrier relationships.

We reserve the right to suspend any campaign or account that we reasonably believe violates this section, without prior notice where necessary to prevent harm or protect platform integrity.

6. Sender verification & consent obligations

RCS Business Messaging requires verified sender approval from Google RBM and, in some cases, carrier-level approval. You are responsible for providing accurate brand and use-case information for this verification process. We do not guarantee approval timelines, as these are determined by Google and carrier review processes outside our control.

You are solely responsible for obtaining and maintaining valid consent from your end recipients before messaging them, and for honoring opt-out requests promptly. SendRCSMessages is not responsible for consent violations arising from how you have built or sourced your recipient lists.

7. Carrier & third-party dependency

The Service depends on infrastructure and approvals from third parties, including Google (RBM/Jibe), telecom carriers (including Jio), and CPaaS partners. We are not liable for service interruptions, delays, or message failures caused by outages, policy changes, or technical issues originating from these third parties.

Device, carrier, and regional RCS availability in India may change over time as carriers roll out or modify RCS support; we will make reasonable efforts to keep you informed of material changes affecting your account but do not guarantee uninterrupted availability.

8. Data handling

We store certain account, campaign, and message-delivery data on our platform/dashboard to provide the Service, including analytics and delivery reporting. Details of what we collect, how long we retain it, and your rights regarding this data are set out in our Privacy Policy, which forms part of these terms.

You remain the data controller for your end recipients' personal data for the purposes of applicable data protection law, and you are responsible for ensuring your own collection and use of that data is lawful.

9. Intellectual property

All platform software, dashboard design, documentation, and branding remain the property of SendRCSMessages or its licensors. You retain ownership of your own brand assets, message content, and campaign creative uploaded to the platform. You grant us a limited license to use such content solely to provide and operate the Service on your behalf.

10. Limitation of liability

To the maximum extent permitted by law, SendRCSMessages' total liability for any claim arising from your use of the Service is limited to the amount paid by you for the Service in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of business, revenue, or data, arising from message delivery failures, third-party infrastructure issues, or carrier-level rejections.

11. Indemnification

You agree to indemnify and hold SendRCSMessages harmless from any claims, damages, or liabilities arising from your use of the Service in violation of these terms, applicable law, or third-party rights, including claims arising from messages sent without proper recipient consent.

12. Suspension & termination

We may suspend or terminate your account for breach of these terms, including acceptable-use violations, non-payment, or risk to our carrier/Google relationships. You may close your account at any time by contacting us; outstanding wallet balance will be handled per our Refund Policy.

13. Changes to these terms

We may update these terms from time to time. Material changes will be communicated to active clients via email or platform notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing law & jurisdiction

These terms are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts at Thane, Maharashtra.
